heypster Studio.

heypster Studio is software for Mac that allows you, among other things, to create, edit, convert, analyze and export digital content, including videos, GIFs and MP4 files.

Some features may use technologies built into macOS and technologies provided by Apple, including Apple Intelligence when they are available and compatible with your device.

heypster Studio features may evolve over time and across versions.

License to use.

Subject to compliance with these Terms, Heypster SAS grants you a personal, limited and non-exclusive right to use heypster Studio for its intended purpose.

heypster Studio is licensed to you, not sold.

Purchasing or downloading heypster Studio does not transfer to you any ownership rights in the software, its source code, interface, technologies, graphic elements or intellectual property.

You remain the owner of the content you create or import into heypster Studio.

Intellectual property.

heypster Studio, its code, interface, design, name, graphic elements, features, documentation and technologies developed by Heypster SAS are protected by applicable laws, including copyright, trademark and intellectual property laws.

Except where expressly permitted by law, you may not copy, reproduce, distribute, sell, rent, license, modify or exploit all or part of heypster Studio without the prior authorization of Heypster SAS.

You may not use the heypster Studio name, trademark or graphic elements in a manner that could imply the existence of a partnership, certification or endorsement by Heypster SAS without authorization.

Reverse engineering.

To the extent permitted by applicable law, you may not attempt to extract, reconstruct, misuse or exploit the source code or proprietary technologies of heypster Studio for an unauthorized purpose.

In particular, you may not use heypster Studio, its operation, resources or components to create or train a system intended to substantially reproduce heypster Studio's proprietary technologies or distinctive operation.

These restrictions do not apply to activities that cannot legally be prohibited, including certain acts necessary for interoperability or for studying the operation of software under the conditions provided by applicable law.

Your content.

You retain your rights to the videos, images, GIFs and other content that you use or create with heypster Studio.

heypster does not claim any ownership rights over your creations solely because they were created, edited or exported using heypster Studio.

However, you are solely responsible for the content you choose to import, edit, convert, create, export or share.

In particular, you must ensure that you have the necessary rights and permissions to use the videos, films, images, music, trademarks, characters or other protected works that you process with heypster Studio.

heypster Studio is a creation tool. A technical capability does not constitute permission to use third-party content.

Prohibited uses.

You agree not to use heypster Studio:

for illegal or fraudulent purposes;
to infringe the intellectual property rights of a third party;
to intentionally circumvent security or protection measures;
to distribute an unauthorized copy of heypster Studio;
to resell, rent or redistribute the software outside authorized mechanisms;
to use the software in a manner likely to compromise its operation, security or the systems with which it is associated.

Any use of heypster Studio must comply with applicable laws.

Apple Intelligence and automated features.

Some heypster Studio features may use automated analysis technologies or Apple technologies, for example, to identify relevant sequences in a video.

These features are designed to assist the user.

Automatically generated or suggested results may be incomplete, inaccurate or may not correspond to the expected result.

You remain responsible for reviewing selected sequences, generated content and exported files before using or publishing them.

heypster does not guarantee that an automated feature will always identify the best moment in a video or produce a result that matches your preferences.

Local processing and backups.

heypster Studio is designed to prioritize processing creations directly on your Mac, in accordance with our Privacy Policy.

You are nevertheless responsible for keeping backup copies of your original files and important creations.

heypster Studio should not be considered a backup or archiving service.

To the extent permitted by law, Heypster SAS shall not be held liable for file loss resulting in particular from deletion by the user, hardware failure, insufficient storage space, corruption external to the software, or a malfunction originating from third-party software or services.

Compatibility.

heypster Studio is designed to operate on the versions and configurations of macOS indicated as compatible by Heypster SAS or on the Mac App Store.

Some features may require a particular version of macOS, a compatible Mac, or the availability of certain Apple technologies.

Changes to macOS, Apple hardware or third-party technologies may affect the availability or operation of certain features.

Updates.

heypster Studio may receive updates intended, in particular, to improve its performance, security, compatibility or features.

Some features may be modified, replaced or removed in future versions, subject to the rights granted to consumers under applicable law.

Where the law requires updates necessary to maintain the software's conformity, such updates are provided in accordance with applicable legal provisions.

Mac App Store and Apple.

When heypster Studio is downloaded from the Mac App Store, the applicable Mac App Store terms also apply.

These Terms are entered into between you and Heypster SAS, and not with Apple.

Apple is not responsible for the development of heypster Studio nor, except where otherwise required by applicable law, for its support or operation.

Purchases, downloads and any refunds made through the Mac App Store may also be subject to Apple's rules and terms.

Software availability.

We make every effort to provide reliable, high-quality software. However, no computer software can be guaranteed to be completely free of errors.

heypster Studio may be affected by bugs, incompatibilities, interruptions or issues arising from macOS, the hardware used, damaged files or third-party technologies.

Heypster SAS may temporarily or permanently modify certain features when necessary for technical, security, legal or product development reasons, in compliance with applicable legal provisions.

Statutory warranties.

Nothing in these Terms is intended to remove or limit any rights that a consumer is mandatorily entitled to under applicable law.

Where the legal conditions are met, consumers benefit in particular from the statutory guarantee of conformity applicable to digital content and services.

The limitations set out in these Terms apply only to the extent permitted by law.

Limitation of liability.

To the extent permitted by applicable law, Heypster SAS shall not be held liable for indirect damages resulting from the use of or inability to use heypster Studio, including loss of business, loss of opportunity or consequences related to the use of a file produced with the software.

The user remains responsible for their original files, their backup, reviewing the results produced by heypster Studio, and their use of exported files.

Nothing in these Terms limits any liability that cannot legally be excluded or limited.

Privacy.

Use of heypster Studio is also subject to our Privacy Policy.

heypster Studio is designed around the principles of data minimization and local processing of creations.

Changes to the Terms.

heypster Studio evolves, and these Terms may be amended to reflect new features, technical developments or legal changes.

The applicable version and its effective date are published on this page.

Where a change requires specific notice or user consent under applicable law, Heypster SAS will comply with the corresponding requirements.

Governing law.

These Terms are governed by French law, subject to any mandatory provisions that may apply in the consumer's country of residence.

Any disputes shall be submitted to the competent courts determined in accordance with applicable legal rules.

General provisions.

If any provision of these Terms is declared invalid or unenforceable, the remaining provisions shall remain in force to the fullest extent permitted by law.

Heypster SAS's failure to immediately exercise a right provided for in these Terms does not constitute a waiver of that right.

These Terms, together with the Privacy Policy and any applicable Mac App Store terms, constitute the contractual framework governing the use of heypster Studio.

In the event of any discrepancy between the French version and a translation of these Terms, the French version shall prevail, to the extent permitted by applicable law.
